Sweepstakes Official Rules

NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW.

1. Sponsor

The CollegeXpress College Search Sweepstakes (“Sweepstakes”) is sponsored by Carnegie Dartlet LLC, 210 Littleton Road, Suite 100, Westford, MA 10886(“Sponsor”).

2. Eligibility

The Sweepstakes is open only to (i) legal residents of the fifty (50) United States and the District of Columbia, (ii) who are at least thirteen (13) years old at the time of entry. Employees of Sponsor, and any of its related companies, parents, subsidiaries, affiliates, as well as the immediate family and household members of each such employee are not eligible. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Void outside the 50 United States and District of Columbia and wherever else prohibited by law.

3. Agreement to Official Rules

By participating in the Sweepstakes, participant agrees to these Official Rules and the decisions of the Sponsor, which are final and binding in all matters related to the Sweepstakes. Whether a participant receives a prize is contingent upon fulfilling all requirements set forth herein.

4. Timing

The Sweepstakes begins and ends on the dates indicated in the promotion announcement (“Sweepstakes Period”). Sponsor's computer, or that of its designee, is the official time-keeping device for the Sweepstakes.

5. How to Enter

To enter, participants must do the following during the Sweepstakes Period:

i. Register for a free account on www.collegexpress.com; and
ii. After you register, answer the short question in the space provided.

NOTE: Sponsor can refrain from selecting an entry as a potential winner if it does not comply with the Entry Requirements (defined below). Proof of transmission does not constitute proof of entry. All entries become the property of Sponsor and will not be acknowledged or returned. Each entry will be deemed to have been submitted by the natural person assigned the email account associated used to register. No software-generated, robotic, programmed, script, macro or other automated online or text message entries are permitted. Sponsor discourages the creation of multiple accounts. All entries discovered to have been submitted by the same individual using multiple accounts will be disqualified. All entries submitted in accordance with these Official Rules shall be collectively hereinafter referred to as “Eligible Entries.” The odds of winning the Sweepstakes depend on the number of Eligible Entries received.

ENTRY REQUIREMENTS: Ineligible entries include those that are unresponsive, as well as those that are, in whole or in part, (i) threatening, abusive, harassing, defamatory, libelous, hateful, embarrassing to another person or entity, deceptive, obscene, invasive of another's privacy, tortious, or contain racial slurs; (ii) contain advertisements, spam, references to other products, offers, websites, competitors; (iii) contain explicit or graphic descriptions or accounts of, sexual acts; (iv) contain email addresses, phone numbers, links to websites, physical addresses or other forms of contact information; or (v) are not within the spirit of the Sweepstakes, as determined by Sponsor in Sponsor’s sole discretion (“Entry Requirements”).

6. Intellectual Property

License: Each participant shall retain ownership of all intellectual property rights in each entry (including moral rights) subject to these Official Rules. However, by entering the Sweepstakes, and to the extent allowed by law, each participant grants Sponsor and its affiliates, licensees, promotional partners, developers and third party marketing entities a non-exclusive, perpetual, worldwide, royalty-free license to edit, modify, cut, rearrange, add to, delete from, copy, reproduce, adapt, publish, exploit and use the entry throughout the world, and in any manner, for trade, advertising, promotional, commercial, or any other purposes without further review, notice, approval, consideration, or compensation.

Warranty: By entering the Sweepstakes, participants represent and warrant that their entries are their own original work and, as such, they are the sole and exclusive owner and rights holder of the submitted entry and that they have the right to submit the entry in the Sweepstakes and grant all required licenses and assignments. Each participant agrees not to submit any entry that infringes any third party proprietary rights, intellectual property rights, industrial property rights, personal or moral rights or any other rights, including without limitation, copyright, trademark, patent, trade secret, privacy, publicity, and confidentiality obligations.

7. Winner Determination

At the end of the Sweepstakes Period, Sponsor or its designated agent will select one (1) potential winner by random drawing from all Eligible Entries received. Sponsor will email the potential winner at the email address used to register and provide instructions about prize fulfillment. Failure to respond to the contact within 72 hours or failure to accept the prize may result in the selection of an alternate potential winner selected by random drawing. The odds of winning the Sweepstakes depend on the number of Eligible Entries received.

Acceptance of any prize shall constitute and signify the winner’s agreement and consent that Sponsor and its designees may use the winner’s name, city, state, likeness, photo, entry and/or prize information in connection with the Sweepstakes for promotional, advertising or other purposes, worldwide, in any and all media now known or hereafter devised, including the Internet, without limitation and without further payment, notification, permission or other consideration, except where prohibited by law. As a condition of receiving a prize, potential winners may be required to execute and return an affidavit of eligibility and/or liability and publicity release, in Sponsor’s sole discretion. Failure to complete and return such documents within the time period designated by Sponsor or its designee may result in forfeiture of the prize and selection of an alternate potential winner.

8. Prize

The winner will receive the prize described in the promotion announcement. All details of prize delivery and fulfillment, including payment method(s), timing and number of payment(s), are subject to Sponsor’s sole discretion. Prize is not transferable. No substitutions may be made, except by the Sponsor, who reserves the right to substitute a prize with another prize of equal or greater value. Limit one (1) prize per person. Winner is responsible for all federal, state, local and income taxes associated with winning prize.

9. Release

By participating, participant agrees to release and hold harmless Sponsor and it parents, subsidiaries, affiliates, suppliers, distributors, and each of their respective parent companies and each such company's officers, directors, employees and agents (collectively, the "Released Parties") from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Sweepstakes or receipt or use or misuse of any prize.

10. General Conditions

Proof of submission does not constitute proof of receipt. Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, and to hold a random drawing from among all Eligible Entries to date if any fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. Sponsor, in its sole discretion, reserves the right to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or any other promotion or in a disruptive manner.

11. Limitations of Liability

The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by participant, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) technical or human error or which may occur in the administration of the Sweepstakes or the processing of entries; (4) late, lost, undeliverable, damaged or stolen entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from participant's participation in the Sweepstakes or receipt or use or misuse of any prize.

12. Arbitration

The Sweepstakes is governed by the laws of the Commonwealth of Massachusetts, without regard to the conflicts of law provisions. All disputes, claims or demands that relate to these Official Rules will first be brought to the attention of the other party and will be resolved individually, without resort to any form of class action. The receiving party shall have sixty (60) days from the date of such notice to remedy the described breach or violation and notify the complaining party in writing of the resolution. If the dispute, claim or demand is not resolved to the satisfaction of the complainant within 60 days, the complainant may request an informal resolution conference (mediation), which if agreed to by the other party will be scheduled to occur within 21 days of the written response. Each party shall have the right to be represented at such a conference by counsel and will ensure that a decision-maker with full and complete authority to resolve the dispute attends the conference. Such conference will be in front of a third party mediator chosen by the parties. If the parties do not agree to conference or are unable to resolve a dispute after such a conference, the parties agree that exclusive jurisdiction for any dispute, claim or demand related in any way to these Official Rules will be decided by binding arbitration. All disputes between the parties, of whatsoever kind or nature arising out of these Official Rules, shall be submitted to JAMS for binding arbitration under its applicable rules then in effect, before one arbitrator to be mutually agreed upon by both parties. The parties agree to share equally in the arbitration costs incurred.

Information collected from entrant is subject to Sponsor's Privacy Policy located at https://www.collegexpress.com/privacy/.

14. Winners List

For a copy of these Official Rules or for the name of the winner, mail a self-addressed, stamped envelope to be received within 3 months from the conclusion of the Sweepstakes Period to: CollegeXpress Editor, 210 Littleton Road, Westford, MA 01886, info@collegexpress.com.
